General Terms and Conditions for Users (Consumers)
1. Scope and Provider
These terms apply to the use of the “Yumder” app and the associated websites (e.g., app.yumder.app) by consumers as defined in Section 13 of the German Civil Code (BGB). The provider is:
Adam Weiß
Auer Str. 47, 76287 Rheinstetten, Deutschland
Email: info@mineco.de
For restaurants that manage their listings on the partner portal, the Partner Terms and Conditions apply.
2. Services Provided by Yumder
Yumder helps groups find a restaurant by swiping. Users start or join a “table,” view restaurant suggestions, vote, and receive a result (match). Additional features include favorites, history, groups, discovery pages, and game elements (XP, levels, collectible cards, quests).
The app can be used at three levels: as a guest without an account, with a free account, and with the paid Yumder Plus subscription. The app shows which features and limitations (e.g., number of participants per table, vetoes, search radius, additional maps) apply at each level. We reserve the right to adjust these limits for future use. We will not unreasonably restrict services for which payment has already been made.
Restaurant information (name, address, hours of operation, cuisine, prices, menus, photos) comes from open data sources such as OpenStreetMap, from the restaurants themselves, and from users. It may be outdated or incorrect. We make no guarantees regarding this information. Please verify important details (e.g., opening hours, allergens, reservations) before visiting the restaurant.
3. Account and Access
You must be at least 16 years old to create an account. Purchases requiring payment are restricted to adults. To sign up, simply provide your email address, and we’ll send you a code. You may only maintain one account per person and must protect access to your email inbox. You can delete your account at any time in the app under Profile > Your Data.
4. Table Etiquette and User Content
Your name at the table is visible to all participants. Do not choose names that are offensive, illegal, misleading, or that infringe on the rights of third parties. Table creators may remove participants. It is prohibited to automatically query, disrupt, or overload the service, or to circumvent security measures.
You may submit photos, menus, and reviews. In doing so, you warrant that you have the necessary rights, that no recognizable individuals appear in the photos, and that the content is not unlawful. You grant us a non-exclusive, royalty-free, perpetual, and worldwide right to display the content in the app and on the Yumder website and to edit it technically for this purpose (e.g., to resize it). This right remains in effect even if you delete your account; any reference to your identity will be removed. We review submissions before publication and may reject or remove them. In the event of misuse, we may block submissions.
5. Game Elements
XP, levels, series, trading cards, event cards, and quests are intended for entertainment purposes. They have no monetary value, are non-transferable, and do not entitle you to specific rewards. We may further develop, modify, or reset them, provided this is reasonable for you.
6. Advertising and Partners
Restaurants can choose to be prominently displayed in the partner portal. Such cards, as well as promotional cards, are marked as “Ad” in the app. The respective restaurants are responsible for discount codes and promotions.
7. Yumder Plus
Yumder Plus unlocks additional features. There are three plans; the app displays the exact prices and features before purchase:
- Monthly Subscription: It renews automatically each month until you cancel.
- Lifetime: A one-time payment for access for the lifetime of the service—that is, as long as we operate Yumder. If we discontinue the service, we will notify you at least three months in advance.
- 24-Hour Pass: One-time payment, valid for 24 hours from the time of purchase and automatically expires thereafter.
The prices shown are final prices. We are a small business under § 19 of the German Value-Added Tax Act (UStG) and do not charge sales tax. Payment is processed through the payment service provider Stripe. Purchases can only be made using a bank account. If you switch from a current 24-Hour Pass to a subscription or Lifetime plan, we’ll apply the amount you’ve already paid toward the purchase price, up to the amount of the new price.
You can cancel your monthly subscription at any time at the end of the current billing period in the app under Profile › Yumder Plus › Manage Subscription. Periods already paid for will not be refunded on a pro-rata basis, except in the event of cancellation or if required by law. We will notify you of price changes for active subscriptions at least four weeks in advance; you may cancel by the end of the current period until then.
The right to cancel is set forth in the cancellation policy. If you expressly request that Yumder Plus begin immediately, the consequences described there apply. You can find a brief overview of cancellation and refunds at legal.yumder.app.
If you delete your account, Yumder Plus will also end. A refund will only be issued if required by law.
8. Availability and Changes to the Service
We strive to ensure uninterrupted operation but do not guarantee uninterrupted availability. Maintenance, disruptions to third-party services, and force majeure may temporarily limit the service. We may modify or discontinue features to the extent that this is reasonable in light of your interests and does not jeopardize the purpose of the agreement.
9. Liability
We bear unlimited liability in cases of willful misconduct and gross negligence, in cases of injury to life, limb, or health, under the Product Liability Act, and to the extent that we have provided a warranty. In cases of slight negligence, we are liable only for the breach of material contractual obligations (obligations on whose fulfillment you may reasonably rely) and limited to foreseeable damages typical for this type of contract. Otherwise, liability is excluded. We are not liable for decisions you make based on restaurant recommendations, nor for the content of external websites linked to by the app.
10. Suspension and Termination
In the event of a material breach of these Terms, we may suspend or delete accounts and content if we have previously issued a warning or if issuing a warning is not reasonable. The right to terminate for good cause remains unaffected.
11. Changes to These Terms
We may amend these Terms for objective reasons, such as the introduction of new features or changes in the legal landscape. We will notify you of such changes within the app and request your consent. If you do not consent, we may terminate your use to the extent necessary to implement the change. We will then provide a pro-rata refund for any prepaid periods.
12. Data Protection
Our data processing practices are outlined in the Privacy Policy.
13. Final Provisions
German law applies. Mandatory consumer protection regulations of the country in which you have your habitual residence remain unaffected. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board. Should any individual provisions be invalid, the remainder shall remain valid.
